Selling Property in North CarolinaThe
following information is required
for For
Sale By Owner (FSBO) and
property listed by a Realtor.
The purpose of this section of
my web page is for give you a
broad understanding of most of
the contracts involved in buying
and selling property. On this
page you will find copies of the
North Carolina Offer
to Purchase contract
for both Residential and Land
purchases. They are lengthily
but not hard to understand. North
Carolina is a consumer friendly
state with most disputes going
to the Buyer. Therefore it is
important that you understand
the contracts. Their are separate
contracts for the purchase on
land, residential and commercial
properties and copies of each
are attached. The contracts
are farther divided by types of
Financing. For example FHA, Va
and Conventional financing require
different contracts. You will
also see a Property
Disclosures,
this contract is for the seller
to fill out, (Realtors are not
allowed to fill out), to the best
of their knowledge. If you don't
know the correct answer it is
best to check "No Representation".
If the residence was built before
1978 you must also fill out a
Lead
Based Paint Addendum. Sellers
or their agent must also have
copies of the Plat, Covenant and
Restrictions, Home Owners Association
By Laws, Tax Information and any
other information that a Buyer
may request. These items are in
addition to a good Marketing Plan.
North Carolina also requires the
the Buyer sign and receive a copy
of "Working
with Real Estate Agents". This
form is not required by a FSBO
because they are representing
themselves and the Seller should
be aware of this. The Seller should
realize that the Buyer could be
represented by a Realtor and
you may be negotiating with a
Buyer Representative.

As a seller if you should decide to list with a Realtor there are contracts that the Realtor will ask you to sign. Part of the contract will be the: Location of the Property including legal address Asking Price Length of contract Special showing Instructions Names and contract information about the owners Name and contact information about Real Estate Brokerage and Agent at the time of listing the property, if a residence, you will be asked to fill out the "Property Disclosure."
