Selling Property in GeorigaThe following
information is required for For
Sale By Owner (FSBO) and
property listed by a Realtor.
The purpose of this section of
my web page is for give you a
broad understanding of most of
the contracts involved in buying
and selling property. On this
page you will find copies of the Georgia
Offer
to Purchase contract for both
Residential and Land purchases.
They are lengthily but not hard
to understand. Georgia is
a consumer friendly state with
most disputes going to the Buyer.
Therefore it is important that
you understand the contracts.
Their are separate contracts for
the purchase on land, residential
and commercial properties and
copies of each are attached. The
contracts are farther divided
by types of Financing. For example
FHA, Va and Conventional financing
require different contracts. You
will also see a Property
Disclosures,
this contract is for the seller
to fill out, (Realtors are not
allowed to fill out), to the best
of their knowledge. If you don't
know the correct answer it is
best to check "No Representation".
If the residence was built before
1978 you must also fill out a
Lead
Based Paint Addendum. Sellers
or their agent must also have
copies of the Plat, Covenant and
Restrictions, Home Owners Association
By Laws, Tax Information and any
other information that a Buyer
may request. These items are in
addition to a good Marketing Plan. In
Georgia the Buyer may be represented
by a Buyer's Agent and a FSBO
may not be represented in the
negotiations. If the property
is listed by a real estate agent,
the listing agent is the sellers
representative.
